Throughout this document, the terms "we" and "us" refer to MUSA Technology Partners, LLC, 1035 Cambridge Street, Suite 6, Cambridge, Massachusetts 02141 and the term "you" refers to any and all customers of MUSA Technology Partners, LLC.
Service Warranty:
We will make every reasonable effort to diagnose your technology problem or issue and provide you with an effective technology solution. However, since the services we provide are dependent upon and affected by the technologies that you use (including, but not limited to, hardware, software and telecommunications systems), there is no guarantee that our diagnoses or solutions will be error-free. In certain cases, we may be unable to diagnose or provide a solution for your technology problem due to an issue with the technologies that you use or their configurations that is beyond our control.
You agree that your use of this service is at your own risk and that your reliance upon this service, and any diagnoses and solutions provided through this service, are at your own risk. You understand that you are solely responsible for any damage to the technologies you use (including, but not limited to, hardware, software and telecommunications systems) or loss of data resulting from any solutions or other materials provided by our service. You understand and agree that it is solely your responsibility to back up the data, software and other information and files on your computer system prior to contacting us or allowing us to perform diagnoses or provide solutions on your computer system. You acknowledge and agree that we shall not be held responsible under any circumstance for any loss or corruption of data or software.
Disclaimer of Warranties and Liability:
Our service is provided as is and as available. MUSA Technology Partners, LLC and our affiliates, agents, consultants and licensors cannot, and do not, warrant the accuracy, completeness, currentness or fitness for purpose of the information and solutions available through our service, nor do they guarantee that the service will be error-free.
Under no circumstances will we and our affiliates, agents, consultants and licensors be liable (to you or anyone else) for any damages resulting out of your use of our services including, but not limited to, consequential, incidental, indirect or other damages, and you agree to release us from liability for said damages. You agree that the liability of MUSA Technology Partners, LLC, and its affiliates, agents, consultants and licensors arising out of any sort of legal claim related to our services and solutions shall not exceed the amount of money you paid for our service.
We also reserve the right to refrain from providing any diagnoses or solutions and instead refund your payment, in whole or in part, upon our determination that your technology needs or other requirements are unusual, extensive or unreasonable and are beyond the scope of the services we normally provide. If our ability to provide diagnoses or services is impaired by you or any other circumstances beyond our control, we may choose not to provide diagnoses or services to you. We reserve the right to refuse service to anyone at any time for any reason.
Privacy Policy:
The services provided by us and our affiliates, agents, consultants and licensors are strictly confidential and we will not disclose any information about you, or the services we have provided to you, unless specified by a legal court order.
